I. Introductory provisions

These Terms and Conditions (hereinafter referred to as the "Terms and Conditions") govern the mutual rights and obligations of the contracting parties arising from the contract for the provision of education and training (hereinafter referred to as the "Education and Training Contract") concluded in accordance with Section 1746(2) of Act No. 89/2012 Coll., the Civil Code, and, in the case of consumers, also Act No. 634/1992 Coll., on Consumer Protection.

The contracting parties are Driving School Brno s.r.o., ID No.: 23657227, with its registered office at Nové sady 988/2, Staré Brno, 602 00 Brno, registered in the Commercial Register maintained by the Regional Court in Brno, and Ing. Karel Koutek – Driving School, ID No.: 09323945, with its registered office at Nivy 1503, Kvítkovice, 765 02 Otrokovice (hereinafter referred to as the "Driving School"), and the applicant (hereinafter referred to as the "Applicant"), who, pursuant to Section 13 of Act No. 247/2000 Coll., submitted a written application for admission to instruction and training.

By signing the contract for instruction and training, the Driving School undertakes to provide the Applicant with instruction and training in accordance with Act No. 247/2000 Coll. and Decree No. 167/2002 Coll. for the purpose of preparing for the final exams, and the Applicant undertakes to actively cooperate and pay the agreed course fees.


II. Course registration

Enrollment in the course is done by completing an application for admission to instruction and training and a medical assessment of health fitness. The driving school may refuse to admit an applicant if they do not meet the legal conditions for obtaining the relevant category of driver's license.


    III. Course fees and payment terms

    The course fee is determined according to the current price list of the Driving School, which is published on the website. https://drivingschoolbrno.cz/.

    The course fee can be paid in a single installment. The course fee is payable no later than the start of practical training, unless otherwise agreed. If the course fee is not paid by the agreed date, the driving school may suspend lessons and training until payment is made. The applicant will be issued an invoice containing all the necessary payment details.


      IV. Rights and obligations of the Driving School

      RThe scope and durationof instruction and practical training provided by the Driving School for the purpose of obtaining a driver's license comply with the requirements of Act No. 247/2000 Coll. and Decree No. 167/2002 Coll. for individual vehicle groups.

      The driving school also provides all related activities and obligations stipulated by Act No. 247/2000 Coll., including the necessary steps vis-à-vis the relevant state administration authorities concerning the acquisition and improvement of professional competence to drive motor vehicles.

        • Before the start of lessons, the driving school shall submit a list of all applicants enrolled in the course to the relevant municipal authority with extended powers.

        • After completing the training, the driving school will register the applicant in writing for the professional driving test or, if necessary, for a retest.

        • The driving school instructor accompanies the applicant to the test and participates in the practical part of the test.

        • The driving school will provide the appropriate training vehicle for the purposes of the test.

        The driving school will terminate instruction and training provided that the applicant has completed the minimum number of hours stipulated by law and has mastered all the knowledge and skills necessary to pass the exam.

        • If the Applicant requests to terminate the course and register for the exam even without being fully prepared, the Driving School will terminate the course on the basis of their written request.

        • For persons under the age of 18, the consent of a legal guardian is required.

        • The driving school reserves the right to assess whether the applicant meets the required level of knowledge and skills.

        The municipal authority with extended powers for the driving school is the Brno City Council.

        • The dates of the final exams are assigned directly by the Brno City Council. The driving school has no influence on the planning or assignment of dates.

        • The waiting period for the exam date to be assigned is not part of the course and is not counted in its total length.

        • Applicants should be aware that there may be a long period of time between the completion of training and the actual exam, over which the driving school has no control.

        Each lesson lasts 45 minutes. Practical driving lessons typically last two lessons, unless the instructor and applicant agree otherwise. Applicants may only register for the test after completing the mandatory scope of instruction and training, reaching the required age, and demonstrating theoretical preparedness.


      V. Rights and obligations of the Applicant

      The applicant is obliged to actively participate in lessons and training at the Driving School so that their education can be completed, as a rule, within 3 months of concluding the Contract for Education and Training. To this end, they are particularly obliged to actively request the allocation of practical training hours at the Driving School. This provision shall not apply if a different duration of instruction and training has been agreed between the Driving School and the Applicant due to the Applicant's individual needs. The Driving School is entitled to cancel the date of the training lesson (practical driving) by telephone or SMS message, or to reschedule it to another date, at least 24 hours before the start of the practical driving lesson; in urgent cases, it may cancel the lesson immediately before it begins. It shall not be considered a breach of the Driving School's obligations if the scheduled practical driving lesson does not take place or is not completed for operational reasons (e.g., vehicle breakdown), illness of the Driving School instructor, or other justifiable reasons. The driving school also reserves the right not to conduct or complete a practical driving lesson at any time if the driving school instructor assesses that the weather conditions are not suitable for conducting the lesson or if there is another obstacle that would prevent the safe and effective conduct or completion of the practical driving lesson.

      The applicant is required to attend the practical driving lesson or final exam wearing appropriate sturdy shoes and clothing to ensure the safe conduct of the lesson and to prevent the vehicle from becoming dirty. If the Driving School considers the applicant's clothing or footwear to be inappropriate, it reserves the right not to conduct the practical driving lesson. The applicant is required to strictly follow the instructions of the Driving School instructor, act responsibly and cautiously, and in the event of a violation of these obligations, the lesson may be terminated. The applicant must arrive in a condition suitable for driving a motor vehicle, in particular not under the influence of alcohol or other narcotic or psychotropic substances; the instructor is entitled not to conduct the practical driving lesson until the applicant voluntarily undergoes a test at the nearest Czech Police station. The applicant is also obliged to attend lessons on time, behave considerately towards the training vehicles and equipment of the driving school, follow the instructor's instructions and observe the rules of the road, and give at least 24 hours' notice of any absence.


      VI. Sanctions

      If the Applicant fails to attend the final exam without a valid excuse, they are obliged to pay a contractual penalty of CZK 2,000. Foreigners who fail to attend the theory exam shall pay a penalty of CZK 2,000 + CZK 5,000 for an interpreter. If the Applicant fails to attend a training drive without an excuse in accordance with the terms and conditions, they shall be obliged to pay a penalty in accordance with the current price list. If the Applicant terminates the course after completing more than 50% of the theory and driving lessons, the course fee will not be refunded. In the event of serious damage to the training vehicle due to the Applicant's actions, the Driving School reserves the right to claim compensation for damages, including minor damage (plastics, levers, mirrors, etc.).


      VII. Teaching, training, and organization

      The driving school provides instruction and training within the scope specified by Act No. 247/2000 Coll. and Decree No. 167/2002 Coll. for the purpose of preparing the Applicant for the final exams. The driving school reserves the right to adjust already scheduled lessons or driving sessions according to its operational needs. The dates of the final exams are assigned by the Brno City Council, and the driving school cannot interfere with them. A record of the course is kept in the driving school's electronic records. 


      VIII. Complaints Procedure

      The applicant has the right to complain about services if they are deficient. Complaints must be submitted in writing and will be dealt with within 30 days at the latest. In the event of a justified complaint, the applicant has the right to redress – repetition of lessons or training at no additional cost.


      IX. Termination of the contractual relationship

      In the event of premature termination of the course, the Driving School will settle the course fee. If the Applicant has completed more than 50% of the lessons and training, the course fee will not be refunded. The contractual relationship shall terminate in the cases specified in these Terms and Conditions or by law, in particular the Civil Code. The Driving School is entitled to terminate the Contract without notice, in particular if the Applicant violates the instructor's instructions and endangers safety, if it is proven that the lessons cannot be continued safely, if the Applicant repeatedly fails to attend, if they cease to meet the legal conditions, or if they are in arrears with the payment of tuition fees. 

      In the event of premature termination of the course, the Driving School will issue a statement of account and any overpayment will be refunded, reduced by any severance pay or a surcharge of CZK 5,000 for administrative costs incurred as a result of the Applicant's breach of obligations. The Driving School will issue a confirmation of hours completed for the purpose of continuing at another Driving School.


      X. Protection of personal data

      The driving school processes the Applicant's personal data in accordance with legal regulations, in particular the GDPR. The data is used exclusively for the purpose of conducting courses, registering for exams, and fulfilling legal obligations, and is not transferred to third parties except for public authorities.


      XI. Final provisions

      These Terms and Conditions are common to both Driving Schools operating the joint website [add website address]. The Terms and Conditions shall enter into force on January 1, 2024.

      Relationships not governed by these terms and conditions are governed by the relevant provisions of the Civil Code and Act No. 247/2000 Coll.
